Fitzgerald for the U.S. District Court for the Central District of California is presiding over the trial.What does Jane Doe have to prove to win?This is largely a he-said/she-said case, which means the jury must decide whose version of that night is more believable.At the trial, both Doe and Rose will put on witnesses and offer evidence to support their version of the events. The legal team for each side will try to use the evidence to their advantage, including the deposition testimony the parties provided before the trial.During his deposition, Rose said that he did not know the meaning of consent and admitted that he repeatedly pushed Doe to send him sexual videos and to participate in group sex but she refused. Does lawyers are likely to highlight those portions of Roses testimony at trial -- particularly as it concerns consent, given that whether Doe consented to group sex is the ultimate issue.Meanwhile, Roses legal team will likely focus on how Doe testified in her deposition to having little recollection about the night. They also will likely raise that she said she sent texts to Rose the next morning about being hung over and seeking reimbursement for cab fare and a sex belt, but admittedly did not mention the alleged rape.Ultimately, the jury must weigh all of the evidence. This is not like in a criminal trial where the prosecutor must prove to the jury that the defendant is guilty beyond a reasonable doubt. Because this is a civil trial, Doe must only prove that her version of that night is more likely to be true than not true.How does the criminal investigation into Rose affect the civil case?On Sept. 22, the Los Angeles Police Department issued a letter stating that there is an open criminal investigation against Rose and his friends for allegedly raping Doe.At this point, no criminal charges have been filed against Rose. The LAPD says the investigation is ongoing.The LAPDs investigation likely will have limited impact on Does lawsuit for several reasons. Generally, police dont release detailed information about an ongoing investigation, which makes it unlikely that Jane Doe could benefit from the investigation during the trial. Also, its unlikely that the LAPD will look to bring charges against Rose until after the trial unless theres a significant revelation in the case that confirms guilt.Why is there a civil trial against Rose before theres any criminal trial?Theres no set order for criminal and civil trials. One can go before the other and vice versa. Typically, if a crime was allegedly committed, a criminal trial would go first, then there would be a civil trial for money damages (assuming the defendant had a source of money).In Roses case, the civil trial is going first likely because Doe was facing a time limit. California law requires an accuser to file a civil lawsuit for rape within two years of the rape. Doe filed this lawsuit on Aug. 26, 2015, exactly two years to the day she alleges Rose and his friends raped her. This is also when her lawyer says she filed the police report. Its not uncommon for sexual assault victims to delay in reporting the crime or not report it at all.Also, it is uncertain whether there will be a criminal trial against Rose, as the LAPD investigation is ongoing.How will the trial impact Roses availability to play for the Knicks?Rose could miss up to two weeks of preseason because of the trial, though coach Jeff Hornacek has said he expects him to play in the Knicks exhibition opener in Houston on Tuesday, the same day the trial is set to begin in Los Angeles.Its estimated that the trial will take about eight to 10 business days. With the courthouse closed for Columbus Day, the trial is estimated to go until Oct. 14-18, but could be delayed or shortened for a number of reasons.The Knicks regular season doesnt start until Oct. 25 in Cleveland. Donovan Smith was called on a crucial hold that required Jameis Winston and Mike Evans to bail out the offense with a 21-yard completion. The Bucs had 114 yards on the ground, but that came off of 32 carries, good for a 3.6 average. Keep in mind that the Browns were ranked 29th against the run coming into this game. Don’t get me wrong, the offense did some good things. They also did some bad things and the good didn’t come consistently enough. Final Grade: 2.0 (C) DefenseJust like the offense, the defense was great and then not-so-great throughout the course of the game. It was obvious that Mark Duffner’s presence as DC gave them energy in the first half. Tampa Bay’s defense pitched a first-half shutout that saw the Browns gain an insanely low 74 total yards of offense. They held Cleveland to 1/8 on third down, sacked Baker Mayfield once, forced four three-and-outs, and kept them from scoring entirely on their one trip inside the red zone. But when halftime passed, something had changed. It still remains to be seen, but Kwon Alexander’s injury most likely had to do with the letdown in the second half. Regardless Buccaneers DeSean Jackson Jersey , injuries happen in football and good teams find ways to overcome them on a regular basis. Tampa Bay allowed over 230 yards off offense in the second half and overtime. 170 of those yards came in the fourth quarter. The average yards per play rose from 2.55 in the first half to a whopping 4.9 in the second half. The Bucs gave up three touchdowns in the process as well. But the bread and butter this week was the pass rush and third down defense. The defensive line got to Mayfield four times - two sacks came from former Brown Carl Nassib - and Adarius Taylor joined in on the fun to make it five takedowns. If Duffner can figure out a way to make the first half results happen for an entire game, then there is plenty of hope left in the season. Final Grade: 2.5 (C+)Special TeamsI’m going to make this short and sweet. Well, not so sweet.I don’t care if Chandler Catanzaro hit a 59-yard kick to win the game. One of the reasons the Bucs had to rely on that kick was because of him in the first place. He missed another PAT attempt and a 40-yard field goal to clinch the game in overtime. Hey, Chandler:You. Are. Getting. Paid. $3.5 million. Do. Your. Damned. Job. Anthony Auclair’s perfect punch-out on the Jabril Peppers fumble is the only reason this unit doesn’t get a big, fat F. That play was enough to raise the grade a couple of points. Final Grade: 2.0 (C) CoachingDirk Koetter isn’t responsible for the dumb mistakes that his players make on the field. You can’t blame him for Cameron Brate’s fumble nor the fact that a receiver ran the wrong route on Winston’s second interception. But you can blame him for foolishly relying on Catanzaro to make a 40-yard game winning kick when he (Cat) has struggled hitting 33-yard extra points. You can blame him even more due to the fact that the Bucs were at the Cleveland 25 with :45 seconds left and two timeouts when he decided to do so. That decision right there just about cost them the game. When it comes to Duffner, I’ll back off a bit because of the Alexander injury. This defense produced and had some great moments despite their shortcomings in the big picture. Final Grade: 2.0 (C)Overall Grade: 2.13 (C)A “C” grade for a win is not good, obviously. I don’t mean to be a downer, but it’s hard to come away from this win satisfied. For two weeks in a row, the Bucs have not only battled opponents, but they’ve had to battle themselves as well. This can’t continue to happen. Not if this team wants to win or make the playoffs. They have another big test this weekend in Cincinnati. He plays in the top unit, meaning he has to stop the offensive aces of the opposition and that’s exactly what he has done.NHL leading scorer Connor McDavid could attest to that.On Saturday, Finland upset star-studded Canada captained by McDavid 5-1 and Heiskanen contributed a great deal.He played 18:25 but his best moment came in the middle period when Canada was trailing 3-1 and desperately pressing to score. At one point, McDavid had just an empty net in front of him. Goaltender Harri Sateri was still at the far post and McDavid’s shot from the left circle was heading for goal.But then Heiskanen came seemingly out of no where to Finland’s rescue, tipping the puck to safety.”It was almost in the net but I hit the puck,” Heiskanen said. ”It was a good save.”When the two met in the third period, the result was a two plus two-minute penalty for high sticking for a frustrated McDavid, effectively ending Canada’s chances of a comeback.Finland captain Mikael Granlund praised Heiskanen.”I have seen him at the games here and nothing really surprises me about him,” Granlund said. ”The way he skates, the way he handles the puck and sees the ice. Except for the victory they so desperately needed.What is it about the Giants and the bad karma of 60+ yard game-ending field goals? In Week 3 of 2017, Jake Elliott of the Philadelphia Eagles beat the Giants with a 61-yarder as time expired. Sunday, Graham Gano drove a dagger into their season with a 63-yarder as time expired that sent the 1-4 Giants to a 33-31 defeat.An angry, raw day for the GiantsBeckham’s comments to ESPN reporter Josina Anderson, aired to a national TV audience and made with rapper L’il Wayne along for the ride, cut the Giants open. The remarks first surfaced on Friday , and they caused coach Pat Shurmur to make Beckham apologize to the team.Shurmur had to be wounded by Beckham’s decision to air his gripes the way he did. The coach has invested tons of time and effort into building a relationship with Beckham, something neither Tom Coughlin nor Ben McAdoo were able to do. Until Friday, all signs were that it had worked. Shurmur had every right to be “livid” with Beckham, as a FOX Sports report indicated was the case.The bleeding hadn’t stopped after the game, something made obvious by the challenging, emotional tone of his post-game remarks. The way the game unfolded didn’t stanch the wound. It pretty much just ripped it open wider, or opened up a whole bunch of new wounds.The phantom unnecessary roughness call on Landon Collins was perhaps the game-changing play. Instead of a Carolina punt, the Panthers were gifted a first down at the Giants’ 44-yard line and turned it into a touchdown that gave them a 26-17 lead with less that 12 minutes to play. Shurmur said he saw Collins “making a play on the ball with no attempt, no attempt to target the receiver.” Several Giants players will be sure to see the NFL lighten their wallets this week after their angry reactions, especially Damon Harrison , who said the Giants had the win “stolen” from them.The questionable giving of a first down to Carolina running back Christian McCaffrey on a third-and-1 at the Giants’ 46-yard line, and the replay booth’s failure to stop the action and review it, was another wound-inducing officiating blunder.That didn’t end up changing the distance of the kick, but the Panthers — out of timeouts — were gifted a first down with 12 seconds left and could then control the clock rather than having to rush Gano onto the field for a harried kick in the waning seconds likely made a huge difference.The gut punch of watching Gano’s kick, which tied the NFL record for the longest game-winning kick ever, sail through the uprights, was just final cruel knife twist for the Giants. But, was it a mortal blow?The Giants are 1-4. They have to regroup quickly and get ready for a Thursday Night Football game against the Super Bowl champion Philadelphia Eagles at MetLife Stadium.When the Giants took a similar gut punch last season, losing to the Eagles on a 61-yard game-ending field goal by Jake Elliott after staging a furious fourth-quarter rally, you could tell from the blank faces and the beaten voices in the post-game locker room that the season was over. There was no anger. There was just shock. And resignation.After that , the season — as all Giants fans know — went all the way off the rails.Will that happen this time?I don’t think so. The Giants are angry now. Not shocked and resigned.They hurt themselves in a lot of ways on Sunday. Beckham wounded them with his words. Manning threw two interceptions before rediscovering the late-game magic that once was routine, throwing two touchdown passes in the final 8:53 and giving the Giants a chance to win. Beckham messed up a punt that cost the Giants a touchdown and he dropped a fourth-and-3 pass that cost them an early scoring opportunity. Saquon Barkley had runs of 30 and 20 yards, yet somehow managed only 48 total rushing yards on 15 carries. The pass rush was mostly non-existent. The tackling was often shoddy. A lot of good things happened, though. The best thing was that the Giants, as Shurmur said, “played hard” and “played tough.”They kept going. Despite falling behind 17-3. Despite the special teams’ mistakes. Despite the two second-half interceptions. Despite losing a fumble recovery because Curtis Riley was out of bounds. Despite their own all-too-apparent shortcomings. Despite the poor work by the officials. The Giants made plays. They dug deep into the playbook for a home run pass from Beckham to Barkley. Despite the awful run-blocking they gave the ball to Barkley often enough for him to create a couple of spectacular runs. They attacked down the field on offense. They kept working on defense, kept trying to hold Carolina at bay. They didn’t pack it in when it was 26-17 and the game looked lost.I have no idea what the rest of the season will be like for the Giants. Maybe they are on their way to another 3-13 season. Maybe they can use their anger, whether it’s at Beckham, the officials, the football Gods who control 60-yard field goals , the media, the schedule-makers for making them play the Eagles on short rest, as a springboard to better results over the final 11 games.I do know, however, that I like these angry 2018 Giants have a better chance of getting things right before the season ends the 2017 version of the Giants ever had.
